Terms & Conditions (New York Compliant)
Community Roadside and Collision
1. Agreement to Services
By requesting or accepting services from Community Roadside and Collision, the customer agrees to the terms outlined below. All services are performed based on the customer’s request and authorization.
2. Service Policy (No Refunds on Services)

All roadside assistance, towing, and collision-related services are final and non-refundable once completed.

This includes, but is not limited to: towing, lockouts, jump-starts, tire changes, fuel delivery, and on-site assistance.

If a service is canceled before dispatch, a refund may be issued.

If a technician has already been dispatched, a service/dispatch fee may still apply.
3. Battery Sales (Exchange Only Policy)

All battery purchases are final sale – NO REFUNDS.

Batteries are eligible for exchange only within 30 days of purchase.

To qualify for exchange:

Proof of purchase is required
-
Battery must be defective (tested/verified)
-
No physical damage, misuse, or improper installation
-

Replacement will be the same or equivalent battery.
4. Parts & Materials

Non-battery parts may be eligible for exchange or refund within 14 days, if:

Unused and in original condition
-
Receipt is provided
-

Special order parts are non-refundable.
5. IMPORTANT – New York Refund Law Disclosure
In accordance with New York General Business Law § 218-a:

This business clearly states its refund policy prior to purchase.

Refunds, exchanges, and conditions are disclosed before services or sales are completed.

A written copy of this policy is available upon request.
⚠️ If a business does NOT properly display its refund policy, New York law may require them to accept returns within 30 days.

6. Payment Terms

Pre-existing vehicle damage

Delays caused by traffic, weather, or unsafe conditions

Services are provided in good faith and with reasonable care.
8. Consumer Protection Compliance

This business complies with New York consumer protection laws prohibiting deceptive or misleading practices.

All pricing, services, and policies are disclosed clearly before purchase.
9. Changes to Terms
Community Roadside and Collision reserves the right to update these terms at any time. Updated policies will be posted and effective immediately.
